Evangelista faces trial on BB gun charge |

Francisco Evangelista will be arraigned in Placer County Superior Court next week on a felony charge of packing a BB gun on the campus of Placer High School nearly three and a half months ago. The 19-year-old Evangelista has been a prisoner in the Placer County Jail since his arrest by Auburn police two days after the August 27 incident.
He was booked for possessing an actual firearm and terrorism/gang activity and the BB gun charge was added several weeks later. At a preliminary hearing last week, Judge Robert P. McElhany tossed out
the firearm and terrorism/gang charges but held Evangelista, a Placer
High grad, for trial on the BB gun rap. No gun, BB or otherwise, has
been introduced as evidence. Judge McElhany also reduced Evangelista’s bail from $500,000 to
$25,000. Even if Evangelista could post the new bail, he still won’t be
getting out of the county jail because of a hold placed on him by the
U.S. Immigation and Naturalization Service, which claims he’s illegally
in the country.
